Tom Gold Hair's the Luxe Lounge Terms and Conditions

These Terms and Conditions ("Terms") govern your participation inTom Gold Hair's Luxe Lounge ("Program"). By enrolling in or using the Program, you agree to be bound by these Terms. If you do not agree to these Terms, please do not participate in the Program.

1. Membership

  • 1.1 Eligibility: the Program is open to legal residents of the United Kingdom who are 18 years of age or older. Membership is limited to one account per individual or business entity.
  • 1.2 Enrolment: enrolment in the Program is automatic and free of charge upon creating an account on tomgold.hair and providing accurate and complete personal information. You are responsible for maintaining the accuracy of your account information.
  • 1.3 Account Security: you are solely responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. You agree to notify Tom Gold Hair immediately of any unauthorised use of your account.

2. Program Structure

  • 2.1 Levels: the Program features a tiered structure based on your total spending on eligible purchases at tomgold.hair within a rolling three-month period, as follows:

  • 2.2 Level Benefits: each level offers specific benefits, including but not limited to discounts, exclusive promotions, and early access to sales. The benefits associated with each tier may vary and are subject to change at Tom Gold Hair's discretion. The current level benefits can be found at https://tomgold.hair/pages/loyalty-program.
  • 2.3 The Vault Points:
    • Earning Points: you earn 1 Point for every £33 spent on eligible purchases.
    • Point Value: each Point is worth £1.
    • Unlimited Earning: you can earn unlimited Points at all tier levels.
    • Redeeming Points: you can redeem your Points for discounts on future orders at any time.
    • Saving Points: while you can redeem points at any time, we encourage you to save them for larger purchases, team use, or to showcase Tom Gold Hair extensions to your clients.
    • Points Expiration: points expire after one year from the date they are earned.
  • 2.4 Qualifying Period:
    • January / February / March
    • April / May / June
    • July / August / September
    • October / November / December
    • Quarterly Assessment: your purchases are assessed every quarter to determine your level status and Point earnings.
    • Level Upgrade: when you unlock the next level, you will receive those privileges on your next order, and for the duration of the current quarter, plus the following quarter. The new level benefits will be valid for at least three months.
    • Level Maintenance: to maintain your tier status, you must meet the spending requirement for that tier within each qualifying quarter.
  • 2.5 UGC Rewards
    (a) Eligible Participants: UGC Rewards are available to active members of the Luxe Lounge with a valid Tom Gold Hair account in good standing.
    (b) Eligible Content: “User‑Generated Content (UGC)” means original photo or video content posted on your own public social media account that clearly features Tom Gold Hair products, tags @tomgold.hair (or any successor handle notified by us), and follows our brand and platform guidelines. Content that is misleading, offensive, infringes third‑party rights, or breaches platform rules is not eligible.
    (c) Rewards: For each piece of Approved UGC, you may earn the following rewards, credited as Points in The Vault:
    • £50 credit for an eligible in‑feed photo post.
    • £60 credit for an eligible short‑form video or reel.

Each credit is treated in line with section 2.3 of these Terms. (d) Approval and Limits: points are only awarded once Tom Gold Hair has reviewed and approved your content (“Approved UGC”). Tom Gold Hair may set reasonable limits on the number of posts per member and per period (capped at £250/month) that are eligible for credits and may decline to award credits where content is substantially similar, duplicated across accounts, or otherwise fails to add genuine value to the community. (e) Timing of Credit: approved UGC Points will usually be credited to your account within 30 days of approval, although processing times may vary. (f) Changes to UGC Rewards: Tom Gold Hair may amend, suspend, or withdraw the UGC Rewards structure (including reward levels, eligibility criteria, and monthly caps) at any time in accordance with section 6 of these Terms. Continued participation after changes take effect constitutes acceptance of the updated UGC Rewards rules.

3. Program Benefits

  • 3.1 Benefits: program benefits may include, but are not limited to:
    • Discounts on eligible purchases
    • Exclusive promotions and offers
    • Early access to sales and new products
  • 3.2 Benefit Availability and Changes:
    • Benefits are subject to availability and may vary by level.
    • Tom Gold Hair reserves the right to modify, suspend, or terminate any Program benefits at any time without prior notice.

4. Returns and Refunds

  • 4.1 Impact on Tier Status: returns and refunds will affect your tier status. The refunded amount will be deducted from your total spending, potentially resulting in a tier downgrade. Points earned from the refunded purchase will also be deducted.
  • 4.2 Return Policy: returns are subject to Tom Gold Hair's standard return policy, which can be found at tomgold.hair/policies/refund-policy.

5. Data Privacy

  • 5.1 Personal Information: by participating in the Program, you consent to Tom Gold Hair's collection, use, and disclosure of your personal information in accordance with our Privacy Policy, which can be found at tomgold.hair/policies/privacy-policy.
  • 5.2 Communication: a valid email address is required for Program communication, including notifications about your level status, exclusive offers, and Program updates.

6. Program Modifications and Termination

  • 6.1 Program Changes: Tom Gold Hair reserves the right to modify, suspend, or terminate the Program or any aspect thereof, including tier structure, benefits, Point system, and these Terms, at any time and for any reason, with or without notice.
  • 6.2 Notice of Changes: material changes to these Terms will be communicated to you via email or by posting a notice on the Tom Gold Hair website. Your continued participation in the Program after such notice constitutes your acceptance of the modified Terms.

7. Opt-Out

  • 7.1 Opting Out: you may opt out of the Program at any time by emailing hello@tomgold.hair.
  • 7.2 Effect of Opting Out: upon opting out, you will no longer be eligible for Program benefits and your tier status will be forfeited. Any accumulated Vault Points will be voided.

8. Limitation of Liability

  • 8.1 Disclaimer of Liability: to the fullest extent permitted by law, Tom Gold Hair and its affiliates, officers, directors, employees, and agents shall not be liable for any damages, losses, or expenses arising out of or in connection with your participation in the Program, including but not limited to any errors or omissions in the Program, any unauthorised access to or use of your account, or any other matters relating to the Program.

9. Governing Law and Dispute Resolution

  • 9.1 Governing Law: these Terms shall be governed by and construed in accordance with the laws of England and Wales.
  • 9.2 Dispute Resolution: any dispute arising out of or relating to these Terms or your participation in the Program shall be settled by binding arbitration in accordance with the arbitration rules of the Chartered Institute of Arbitrators. The arbitration shall be conducted in London, England, and the language of the arbitration shall be English.

10. Entire Agreement
These Terms constitute the entire agreement between you and Tom Gold Hair relating to the Program and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
